Why do some couples choose legal separation? It could be a way to keep one spouse on the other's health insurance. Some couples choose legal separation for religious reasons. Some couples are simply not ready to take the final step of divorce.
How does legal separation differ from divorce? The process for legal separation involves all of the same issues that the process for divorce involves, including custody, visitation, child support, spousal maintenance, and division of property and debts. Unlike divorce, legal separation does not end all of the legal rights and relationships resulting from marriage.
After the legal separation is ordered, what if one of you wants a divorce? If either spouse later wanted to marry someone else, that spouse would have to file for divorce regardless of the fact that the parties had already been legally separated. Talk to a family law attorney to help decide if legal separation is the option that would work best for you and your spouse.
