Do you work? That is usually the first question. You may be able to file for emancipation, but you must be able to prove that you can support yourself.
Under Arizona law, a teen who is at least sixteen or seventeen years old can request emancipation by filing a Motion with the Superior Court.
If granted, the effect is significant:
- Your parents would no longer have any financial responsibility for you
- They would not be required to provide health insurance, food, or clothing
- You would be legally independent from your parents or guardian
- You would take on many of the rights and responsibilities of an adult
There are specific requirements you must meet:
- You must be at least sixteen years old
- You must be a resident of Arizona
- You must be financially self-sufficient
- You cannot be a ward of the court
You will also need to show that you have been living on your own for at least three months, or explain why your current home is unsafe, or provide notarized consent from your parents.
