The Question:
If your ex-spouse exaggerated debts during your divorce, leading to an unfair division of property and funds, can you reopen the case?
RJ Says:
Arizona rules allow for altering or amending a court’s rulings in cases of newly discovered evidence, fraud, or misconduct by the other party. This can include situations where material evidence, such as misrepresentation of debts, could not have been discovered and presented at trial despite reasonable diligence.
If you learned about this issue within six months of the divorce decree, you could file a motion under Rule 83(a)(1). However, since your divorce was finalized over a year ago, this deadline has passed.
Fortunately, Arizona’s rules include a catch-all provision that allows you to request relief for “any other reason that justifies relief.” This motion must be filed within a reasonable time after discovering the new information. The claims would need to align with the same factors of fraud, misconduct, or newly uncovered evidence.
