Do I have to take my son to visit his father in another state because school is out for the Corona virus? I have primary physical custody of our son. School has been cancelled for 1 week after spring break. My son had visited his dad in another state and since returned home. Now that his dad found out that school is on hold, he wants my son to come back to visit him. This is not a vacation time. It’s suppose to be time spent distancing self, not traveling. He keeps threatening me with court if I don’t comply. Am I obligated to take my son back?
We are experiencing a new dynamic that I have not seen in my 28 years. Without knowing the particular wording in your Orders, my best answer would be that unless your Orders are written in a very odd manner, I think it would be very difficult for him to force the child’s return. I also think that, if he did file something, you would have very strong arguments in response that returning is contrary to the child’s best interests.
