The Question:
How do I file for divorce with someone who is in prison in Arizona that I haven’t seen in over 9 years?
RJ Says:
If you are aware up where he is incarcerated, you can simply file a regular petition for dissolution and have him served within his facility. Each facility has different methods for getting a prisoner served. It is typically simple to do though.
Or, if you simply cannot locate him, it is possible to get single in Arizona even without having the other party served. Proceeding in that manner has certain limitations because the court is not permitted to divide community property, divide community debt, or award spousal maintenance. However, you can in fact be single after this process.
