Was My Husband Legally Served If He Returned the Divorce Papers?

Was My Husband Legally Served If He Returned the Divorce Papers?

The Question:
If you sent your spouse divorce paperwork via restricted mail, they signed for it but returned it unopened, does that count as being legally served?

RJ Says:
If your husband signed the certified mail receipt, it appears he was legally served. Arizona law allows service by mail, provided it meets specific requirements:

  1. The summons and documents must be sent via postage-prepaid mail with restricted delivery and require a receipt signed by the addressee.
  2. You must file an affidavit confirming:
    • The person served is located in Arizona or within a U.S. judicial district.
    • The summons and documents were mailed as described under Rule 41(d)(1).
    • A signed return receipt is attached to the affidavit, showing the person received the documents.
    • The date they received the documents.

Importantly, your spouse choosing not to open or review the documents does not invalidate the service.
